Terms of Service

1. Agreement to Terms

By accessing or using the Replicmate mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

Replicmate is operated by makermate OÜ, a company registered in Estonia at Tornimäe tn 5, 10145, Tallinn, Estonia (hereinafter referred to as "we," "us," or "our").

2. Description of Service

Replicmate provides a mobile application that allows users to:

• Capture photographs using their mobile device camera
• Convert photographs into 3D models using AI technology
• Send generated 3D models directly to compatible 3D printers
• Manage and store their 3D model library

The service is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect of the App at any time.

3. User Accounts

To access certain features of the App, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. User Content and Intellectual Property

4.1 Your Content

You retain all ownership rights to the photographs you upload and the 3D models generated from your photographs. By using the App, you grant us a limited, non-exclusive, royalty-free license to process your content solely for the purpose of providing the service.

4.2 Our Intellectual Property

The App, including its design, functionality, code, algorithms, and all related intellectual property, is owned by makermate OÜ and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, sell, or lease any part of the App without our express written permission.

5. Prohibited Uses

You agree not to use the App to:

• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Upload content that is illegal, harmful, threatening, abusive, or offensive
• Generate 3D models of weapons, dangerous items, or illegal objects
• Attempt to reverse engineer, decompile, or hack the App
• Use automated systems to access the App without authorization
• Interfere with the proper functioning of the App
• Impersonate any person or entity

6. Payments and Subscriptions

Certain features of the App may require payment. By subscribing to paid services, you agree to:

• Pay all applicable fees as described in the App
• Provide accurate payment information
• Authorize us to charge your payment method for recurring subscriptions

Subscription fees are non-refundable except as required by law. You may cancel your subscription at any time, but cancellation will take effect at the end of the current billing period.

7. Third-Party Services

The App may integrate with third-party services, including 3D printer manufacturers and cloud storage providers. Your use of these third-party services is subject to their respective terms and conditions. We are not responsible for the actions or policies of third-party service providers.

8. Disclaimers and Limitation of Liability

8.1 Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT:

• The App will be uninterrupted, secure, or error-free
• 3D models will be accurate or suitable for your intended purpose
• 3D prints will be successful or match your expectations
• The App will be compatible with all devices or printers

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAKERMATE OÜ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE APP.

9. Indemnification

You agree to indemnify and hold harmless makermate OÜ, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App or violation of these Terms.

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the App will immediately cease.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last Updated" date. Your continued use of the App after changes constitute acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Estonia.
